Understanding the Rule 5 Amendment (Traps for the Unwary)
|
Abstract: Rule 5 of the North Carolina Rules of Civil Procedure governs filing and service requirements for civil litigation in this state. The prior rule included a general presumption of papers and materials to be filed followed by a proscriptive list of exceptions that the legislature amended from time to time over the years. The result was a broken rule with internal inconsistencies and conflicts with other existing rules. The amendment approaches the issue from the opposite end and sets out what should and may be filed and then prohibits the filing of any other materials unless the circumstances meet certain criteria. The amendment also adds a significant new aspect to service requirements by mandating that each item served in the course of litigation must be accompanied by a certificate of service with the entire contact information of each person served and further requires that the certificate of service be signed by the serving party or attorney subject to Rule 11.
